1. Scope of agreement
OnionStacks (“OnionStacks”, “we”, “us”, “our”) provides an online marketplace and provisioning platform through which registered users (“you”, “the user”) can order Fibre, LTE, 5G Fixed Wireless, VoIP and Hosting services from South African networks. By creating an account, placing an order or activating any service on the OnionStacks platform, you irrevocably accept these terms. Please pay special attention to the clauses in bold.
2. Consent
By using the service you consent to OnionStacks processing your personal information as described in our Privacy Policy. You consent to receiving transactional communication about your orders, invoices, coverage checks and service status. Marketing communication is optional and can be unsubscribed from at any time.
You consent to OnionStacks and its upstream network partners applying reasonable traffic management (packet shaping and fair use) so that the network remains available for all users.
3. Interpretation
- “OnionStacks” means OnionStacks, the operator of the onionstacks.com marketplace.
- “Service” means access to the OnionStacks platform and any Fibre, LTE, 5G Fixed Wireless, VoIP or Hosting product activated through it.
- “User” means any person or entity that registers an account, places an order or uses the service.
- “Sales Agent” means a user approved under the OnionStacks Sales Agent Program to refer customers in exchange for commission.
- “Upstream provider” means the underlying network, fibre network operator (FNO), mobile operator, VoIP carrier or hosting supplier that OnionStacks resells.
- “Consumer Protection Act” means the Consumer Protection Act 68 of 2008.
4. Provision of service and your responsibilities
You confirm that you have the equipment required to use the service you order — including a working fibre ONT and router, a compatible LTE / 5G router, a VoIP handset or ATA, or a compatible device for hosting — and that you have the authority to contract on behalf of any business or entity you represent.
You are responsible for maintaining your own equipment, your account credentials and the security of the network on your side of the connection.
5. Network availability and acceptable use
We use commercially reasonable effort to keep the service available. Because OnionStacks depends on multiple upstream networks, we do not guarantee 100% uptime and advertised speeds are theoretical maximums provided on a best-effort basis. No formal service level agreement is offered unless expressly agreed in writing.
You may not use the service to circumvent authentication or security, launch denial-of-service attacks, distribute malware, send spam, host illegal content or otherwise breach South African law. Any such use is a material breach of these terms and entitles OnionStacks to suspend or terminate the service immediately without a refund.
OnionStacks or its upstream provider may apply a Fair Use Policy to manage users whose consumption is compromising the network for others, including throttling specific protocols such as P2P, newsgroups, bulk file-hosting and certain video-on-demand services.
6. Fibre services
- Fibre installations are performed by the applicable Fibre Network Operator on the FNO’s standard installation terms and timelines.
- Installation fees, activation fees and any equipment charges are published on the applicable product page at checkout.
- Tampering with or reconfiguring the ONT may result in a call-out fee charged by the FNO and passed through to you.
- Fibre packages are month-to-month unless a specific promotional contract term is displayed at checkout.
7. LTE, 5G Fixed Wireless and Mobile SIM services
- All LTE and 5G Fixed Wireless services are best-effort. Speeds depend on coverage, distance to the tower, weather and tower congestion.
- Location-locked SIMs (including MTN 5G Fixed) may only be used at the address supplied at order time. Using the SIM outside the approved location may lead to suspension by the mobile operator.
- Unused monthly data is forfeited at the end of each calendar month unless the product page explicitly says otherwise.
- Top-ups and add-on bundles are valid for 30 days from purchase and are non-refundable once activated.
- Hardware supplied by OnionStacks or the upstream network carries a 12-month manufacturer’s warranty. Faulty units are swapped out at the applicable courier cost.
8. VoIP services
- Number porting timelines are controlled by the losing operator and ICASA processes; OnionStacks facilitates the request but cannot guarantee port dates.
- Emergency (112 / 10111) calls over VoIP may not always reach the correct dispatch centre. Keep an alternate means of contacting emergency services.
- Call rates, monthly fees and included minutes are those displayed on the applicable VoIP product page at order.
9. Hosting services
- Hosting products are provided on shared or dedicated infrastructure as described on the product page. You are responsible for the content you host and for keeping backups of your data.
- Content that is illegal, infringes third-party rights or endangers the platform may be suspended without notice.
10. Orders, payments and coverage
Prices displayed on the OnionStacks marketplace are in South African Rand and include VAT unless clearly stated otherwise. Payment is processed securely via Ozow. An order is only accepted once payment is confirmed and coverage has been validated for services that require installation or a location lock.
For services requiring installation or a fixed serving address you must pin your exact location during checkout. If coverage is not available at that location the order will not be provisioned and any payment already taken will be refunded per our Refund Policy.
11. Sales Agent Program
Participation in the OnionStacks Sales Agent Program is subject to approval, KYC verification and the separate Sales Agent terms shown during application. Commissions are paid on qualifying, fully-paid orders and may be withheld or reversed for fraudulent, self-referred or refunded orders.
12. Suspension and termination
OnionStacks may suspend or terminate any service where payment is not received, where the service is abused, where the upstream network requires suspension, or where continued provision would breach South African law. You may cancel a month-to-month service at any time by giving written notice before the next billing cycle.
13. Limitation of liability
To the maximum extent permitted by law and by the Consumer Protection Act, OnionStacks is not liable for indirect, incidental or consequential loss (including loss of profit, data or business opportunity) arising from your use or inability to use the service. Nothing in these terms limits any liability that cannot lawfully be limited.
14. Changes to these terms
We may update these terms from time to time. Material changes will be communicated by email or through the platform. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
